I am almost positive that the 5 year residency requirement does not apply to any passenger carrier. Someone once explained it to me by saying that even though pax carriers do carry USPS mail/cargo, it is not carried in the main cabin, which is accessible to the pilots in flight. Don't really know if that's the reason behind it.

FYI, commuting contracts like the ones with Air Japan (ANA), and Korean Air, do not affect your U.S. residency status. You would still be able to apply/work for FDX, UPS, Kalitta, etc... Something you might want to look into before taking a job overseas.

Ok, quick question, because I don't know how things at FedEx works. They have a Hong Kong and a Cologne base, right? So, you move there, because commuting there would be pretty painful. You are based there for a couple of years and can hold MEM. Now what? You have been living overseas for more than 6 months and you want to fly the mail out of MEM.

This is not a requirement at UPS. We've hired plenty of foreign nationals and Cathay pilots who had been living in HK.

The difference here is that the pilot already works for FedEx.(isn't applying to work her, and is a Known quantity)
He/She has been fingerprinted and background checked and passed.

If you need the legal precedent, go find it if you are interested in applying at FedEx. In the interim, the FDX guys are repeating over and over that it is a requirement of getting hired at FDX.

Simply put, a requirement is a requirement, just like flight experience. Sorry for those that cannot meet all requirements. To ask the FDX guys over and over for the rationale for the requirement, as you have seen, isn't getting you your required answer.

Perhaps if you spent a little time researching it, you'd find the answer in postal regs, laws, etc. as you asked others to research and state for you. Those already hired have met the requirement. Those in the pool have met the requirement. If you don't meet the residency requirements and are seeking some sort of relief, do the footwork yourself. It may be some sort of Postal Service security thing that precludes a full up back ground check for hauling the mail. Interesting, if that IS the reason, taken that the Post Office employees have caused a common term to be coined because of some of their actions..... "GOING POSTAL,"

As you may be aware, there is a rock fight going on in the FDX HKG domicile right now. The definition of "home of record" is one of the issues. If you are in the gray area, it may not be the best of times to seek a waiver or creative interpretation from FDX corporate hiring.
