Terminated HKG pilots - update...

I thought 4a2b taught us that it is acceptable to steal? You reap what you sow.
The company has just started taking hostages earlier than usual for contract negotiations. I hope they get slammed.
Any way we can help these pilots? Fund set up for them somewhere? Assessment? At a minimum, all 901 area code phone calls should be answered with the word 'no' until the company wises up.

[QUOTE=EighteenWheeler;1205094]See the post explaining residency. You’re making the same errors many people unfamiliar with the situation make. Being a resident of a state is necessary. Every HK pilot does it. There is no requirement to sever all ties to your home state.
"Can you still claim to be a Hong Kong resident for purposes of the FedEx FDA? Doesn't pass my smell test but I'm not a lawyer."
Not sure what error I'm making Mr. 18Whlr? The facts I mentioned came to me in an email which included a letter from the terminated pilot. (How I got on the addressee list is still a mystery). You did explain some interesting points that were previously not considered by me........BUT, It still doesn't pass MY smell test. Good news for the 4 pilots, I'm pretty sure the Judge doesn't allow my "smell test" as admissible evidence, but once again "I'M NOT A LAWYER." CB out!

The error is that the FDA language refers to "a ... residency" and FedEx cannot make a US citizen become a HK resident, as it is not legal. You refer to "claim to be a HK resident," which is not the issue. You only have to establish and maintain your residency (dwelling) in HK.
They wrote this crazy stuff, not me. I'm just reading what it says, and all the HK pilots have had to deal with this crap for over 4 years now...

You can get wrapped up in this residency stuff if you wish. It's pretty obvious to me that the company did not expect anyone to become a resident of HKG. However, they did expect guys to move their family to HKG. This doesn't appear to have happened based on the info posted by JB. I realize all the info may not be out there yet.
Now the part about the company "didn't act optimally in all cases." My best guess is at some point these guys contacted the ACP or someone else about their situations and were told it was ok. Obviously, someone higher up decided they didn't have the authority to give this ok. Which may be why they're getting a new ACP in HKG. However, this may be enough to save their jobs when it goes to arbitration, or court or wherever this thing is headed. Hopefully that will be the result.
If my suppositions are correct, then in my opinion what would have been fair is for everyone to have received a cease and desist order and clarification given to everyone. Unfortunately, this is not the case.
