The company wants people living in domicile to increase their efficiency (yes...they pick up more Open Time/Draft trips, which lowers their FDA manning requirements)

On the other hand, there's the single guy who moves there, gets a place but chooses to spend his days off in the USA with his squeeze. Last I checked, what we do on our days off isn't the business of anyone at Fedex. They can't make a pilot stay in Hong Kong when he's not working. It may look like he's commuting but as long as he makes his trips, I can't see what they can do about it.

What if the rest of the story is that She said "f-this place," grabbed his kids and went back to said northwestern state? How quick does the divorce have to go through? Nice of the company to pile on.

Then I would think they'd have nothing to worry about. If someone is doing the right thing, it will stand up to scrutiny. However, if that person never moved his family there and and commutes back stateside as soon as his trips are over, well then he might have something to worry about.

Most of us don't have all the facts. But, even though I never planned to bid either FDA, I read the LOA. I voted no, and voted no again.
That said, it is very clear. Either you live there or you don't. For a single guy with no kids, I don't see any problem having another house in the states. I don't see that as a violation of the agreement. He does not have dependents that are required to live there.
But for the married guy with kids, the LOA mandates them living there if you want the extra $$$. If your wife and kids live in the States and you have a rental in HKG, this isn't compliant with the LOA. It isn't difficult to find out what their situation. If my family wasn't living in HKG, I believe I'd take the company's amnesty offer and pay back the cash. That's just me though..
Maybe people will wake up and actually read these agreements before voting for them. It has always been a terrible deal. I never understood why I had to move my family to an FDA to get the extra money. Just renting an apartment and living there half the month is very expensive. The extra money just covers the cost of a nice crashpad and some living expenses.
You want to change it? No one bid the FDAs. It will get changed. Until then, we will have to live within the rules of the current LOA. It is specific and the company is enforcing the rules. If I were having to paying back the money, I'd bid out of HKG immediately.
