Yes, we do. How is commuting on a jumpseat or jumpseating on a commercial carrier into Memphis to start a trip considered "deviating?" That's just commuting. Reread the section.

A pilot shall designate on his online expense report any claim for deviation
travel expenses
incurred while commuting to or from his base. The amount
of such claim that is allowed/reimbursed shall be included in the pilot's
income as taxable compensation and all applicable taxes will be withheld.

The Employee Parking Passes we must buy or Airport Parking Fees we must pay at the Outlying Ramp station is a deviation (commuting) expense.

Any Taxis/ limo's to/from the Airport of Residence is a Deviation (Commuting)
expense.

Often we must buy a commercial ticket to get to MEM (jumpseating offline is often too risky) to position ourselves for a trip.........Monday Mornings, Sun Mornings or Evenings there art No FedEx jumpseats to MEM.

All these is a Deviation Expenses...........

Fedex guys...

Does fedex make you guys pay to park in MEM when you come to work? Brown provides secure parking in domiciles for crewmembers. For reserve call out in SDF, you are checked in when you swipe your card entering the lot.

If we have to commute to SDF on a Sunday, we have to buy a ticket or js. I would welcome the opportunity to have the company buy my ticket and I will pay tax on that as extra income.

Yes FedEx has Free parking for Us in our Domiciles. (MEM, ANC. and LAX)

70% of our crewmembers commute. They do not give us passes at our Field stations where many of us live. We can expense the costs if we have $$ in our Deviation Banks..............(Money from unused Scheduled Commercial DH's)

I live in DEN................If I am lucky enough to get a trip that has a Commerical DH from MEM-DEN to begin a revenue flight DEN-IND or DEN-OAK or DEN-MEM...........the value of that DH ticket gets put in a monthly Bank which for that month I can use to buy a Ticket to MEM later in that month to begin another trip that doesn't begin with a DH or if I need to go to the sim for Trng.......... or use it to buy a DEN parking permit ot for a couple Taxi rides to/from DEN airport.

It is a good deal and saves FEDEX alot of money. It was never taxed before.........so it appears to us a give back whether or not it is an IRS requirement....If we got to live with it so be it.but it is a windfall for the company as they will now save even more................

What are you worried secret IRS auditors are listening in as we speak??

I emailed my rep twice and have not received a response.

No, buying a ticket to get to MEM for your assigned trip is not a deviation expense. It is the cost of commuting and not living in MEM, and if you use company money for it, then it's reported as income. Keep *****in, and all those limos and parking passes may become taxable income, also. As mentioned at the road show, this is an IRS deal, not a company deal. By putting it in Contract language, we avoid an IRS audit of our deviation system, according to BC.

The NC Chair explained this thusly:
The company was afraid of an audit that would find them noncompliant with the tax laws....this happened to Polar and they got wacked with fines. So, they were going to actually check out expense reports and include these expenses as earned income on the LES and W-2. OK, thats still going to happen, but only on the "reported" expenses . They say they aren't going to check what you report and the IRS isn't looking.......ssooooooo do what your consciense dictates

I beg to differ............if one has bank buying a ticket to/from MEM to start or end a trip or travel to/From a Simulator is a deviation expense and it has been allowed and reimbursed since I have been here.
