One issue was when do you start passover since NOBODY was training on the same bid (08-03). While all of us have plenty of opinions on what we think would be "fair", "common sense", or "contractual", the fact is it was a contractual gray area that had to be hashed out with a bunch of lawyers..........
Albie, you mention "a contractual gray area." To be quite honest, I disagree. Didn't the contract state a pilot, who was excessed, could bid any seat which someone junior to him/her held? However, there was a caveat that they couldn't go to an FDA, if that would in turn create an excess at the FDA. The contract continued, stating that the pilot would however, be entitled to passover pay(I bet the company would like a mulligan on that miscue). And passover pay, although the company would have you believe otherwise, appears fairly straightforward. That is, someone junior to you checks out, you start getting paid that higher amount.
Perhaps I'm demonstrating my ignorance. If so, I'm sure many will be quick to respond, and I'll be the first to apologize. I don't have the contract in front of me. However, when I read the signed agreement between DW and PC, I don't get a bunch of warm fuzzies. In fact, that agreement only seems to muddy the waters. Is it a clarification or a change to our voted on contract? Lack of trust...you bet. But remember, "it'll go senior."

I thought like you did, and to an extent still do. However, the better folks to 'splain all this are Coy and the legal crowd. The issue isn't whether the pay is warranted, but WHEN it starts. That was source of a lot of the legal wrangling. I thought I gave a pretty clear disclaimer...what appears "common sense" sometimes can get manipulated in legal circles. So...that is why I urge you to take your questions and concerns to the guys who can answer them. I can't. Not because I WON'T answer, but because the hows and whys and legalese are beyond me. Coy has done a great job explaining things in the past...so I suggest you give him a buzz.

Does this mean that the ones that bid 77FM lost their HKG passover pay?

Yes, if their current position was a widebody F/O or narrowbody Capt., and they were getting passover for HKG Capt.
Of course, we don't really know what the 777 is going to pay yet, do we?

Not so fast...it depends what their excessed position they were bidding from. I know 727 cap that bid HKG in 08-02, but was excessed to 727 FO. He also bid 777 FO in latest bid. That is a bid up in pay because his current award is 727 FO eventhough he is still an active 727 Capt. I could be wrong, but he should still get his FEPP.

I would think so if he still had HKG Capt (100%) on his bid ahead of the lower paying seat.

This agreement seems to favor the company. The strategy some have espoused to bid HKG captain and get passover is somewhat nullified by the 8 per month virtual training. Instead of 200 guys being immediately eligible for passover, it will take over two years for the final guy to begin receiving passover. Seems like a major giveback to me.
