Default FDX - CIC/Open time assignment

Can anyone answer this before the ALPA offices open?

I wanted to get trip 358/30OCT, https://pilot.fedex.com/vips-bin/vipscgi?webtr as CIC makeup. This trip was in open time and showed it was going to be IOE. I know it is all about me, but would have been nice to be bumped for 48 hours. Anyway, it was in open time until this morning, now the IOE student is in the seat, so the trip is no longer in open time.

Is this legal? I thought per the contract, only pilots were to have acces to open time until 12 hours after open time opened.

The Company is probably using this paragraph, the real question is what defines the "resolution" of phase in conflicts. I know the Company is simply defining the process as the phase in conflicts are complete and now we get to pick out of the pool first. This was a huge negative in the 2006 CBA for me.

G. Open Time Assignments
1. Following resolution of phase-in conflicts, open time may be
used in the following order: training assignments, phase-in
make-up (including MUV, as provided in Section 7.G.5.a.), and
then substitution/reassignment. Remaining open time shall be
used for construction of secondary and conversion lines.

That is the same paragraph that I read, but I just keyed in on the last part.

25 G.
However, during the first 12 hours after the publication of open time, only pilots shall have access to open time trips starting in the new bid period.

Resolution must mean when all the conflicts are taken care of and trips are dropped, not when the pilots actually get to resolve their schedule, ie. CIC.

That part refers to Mad Thursday when Open Time is opened up to the masses

I'm pretty sure that sentence applies to Open Time Release next Thursday.
