The recent legislation changing the regulated age appears to have generated some confusion or misunderstanding as to how individual pilots gain seat positions at FDX. Though there have been previous communications addressing this issue, the particulars bear repeating. We work in a seniority-based system that is recognized under federal law and covered by our CBA and Section 24, Filling of Vacancies, is explicit in its determination of how individual pilots bid for vacancies and excesses. The bill signed by the President does not negate these provisions; in fact it clearly holds collective bargaining agreements steadfast by including language that prohibits unilateral changes to union contracts as a result of the new law. To be clear, there can be no changes to our contract without negotiations.The MEC’s position continues to be that a vacancy bid is required for a pilot to move from their current award to another, based on that pilot’s seniority as well as the ability to meet certain medical requirements. The company’s ability to take a pilot currently holding one award and award them another is severely limited by the CBA. Once the company has examined potential scenarios prompted by the regulatory age change, and communicated with the union their intentions, we will have a clearer picture of what lies ahead. When that happens, rest assured that FDX ALPA will continue to defend the CBA and its provisions as well as the collective bargaining process governed by the RLA.

I don't think so the message line said current award. One thing is for sure GC at 60 and a few months is not currently AWARDED MD-11 Captain. He will be able to bid back in a few years ... if his shoulder gets better Maybe he will be able to hold HKG or CDG slots sooner.

I had recurrent last week in MEM and Gasko came in and talked about a planned bid of some sort (he used some term I can't recall) coming up to move the 60+ year olders back into the front seat. Didn't go into a lot of details but he was serious and it did not sound good. I suppose if the company determined that it was beneficial to move these guys back then they would come up with some sort of mechanism and I doubt DW would lift much of a finger to protect the rules of the CBA. Does anyone have any evidence of DW doing anything for junior folks ever?

I asked, "What do you want him to DO to stop the bid?" But I could be more verbose and add that he said they will ensure that all is done in accordance with the CBA, so why would you ask him to do otherwise and exactly what power do you think the union has to stop/start bids?
