The guys from FedEx had a choice. You did your best to Scr#w the rest. You may not have heard the last from the pax guy forced out since 10/26/06 to the age change date.

My hypothetical was trying to demonstrate the POSSIBILITY that the MEC can abrogate seniority. The company and Association have a business relationship. If the company states it needs to furlough 150 by seat assignment (approx. 3% of the pilot group) and will maintain the current pay for the other 97%, essentially only affecting a small number of individuals, do you trust this current MEC? It will essentially abrogate the min BLG section 4 and the furlough in section 23. The Association has already proved that it will set aside sections of the contract (see FDA LOA) to help the company. I do hope that this will not occur but it is a possibility that was not discussed by other posters.

Who are "the guys from Fedex" and what choice are you referring to?
Who is the "you" and who are "the rest" in your sentence "you did your best to $crew the rest?"

Any FedEx pilot that reached age 60 prior to 12/13/07 had a choice to either retire or stay as a S/O until the age limit changed. The you is plural for all those that still make it very clear that you would go to any length to stop the return of the S/Os to the left or right seat. Glad to say your position is not supported by either the law or the contract. As much as you guy are trying to twist things it is about time for you to face reality. The only real question is whether age 60 S/Os will require a bid to return to there seat. I have no idea what the company plans but they hold all the cards. Interesting times we live in.
