I loath getting into this conversation, but in the interest of spreading the facts, and having gone through HR interview training, your past employers can only say whether you're eligible for rehire and if you've failed any training events or drug tests.

There are certainly "wink, wink, nudge, nudge - Bob's your uncle" kind of messages that can be sent, but if you can prove that, for good or ill, your old company said anything other than this limited scope of information, and you don't get the job, you have grounds to sue the company trying to hire you AND the company/individual who "defamed" your character.

If the hiring company can find out this information from police records etc. that's another story.

Do I agree with this... Not so much. But it's what they told us while training us how to interview candidates. Take it for what it's worth.
