That absurd. The motion for en banc hadn't been filed yet. The process wasn't close to being over and the 9ths mandate was 6 weeks from issuance. It's not the prevailing party's job to do the work of a Federal Judge. Silver is a nut case. But in the end. It doesn't matter at all. The arbs were never required to use the Nic regardless, and now the East has been forced to go all in without any ability to litigate when they don't like the outcome. The 9th still boosted the Wests case big time and now it's 2 to1 in favor of the Nic. The two front war has shifted to the East.

No that's not how it works, the last word should come from winning side, when Conrad enjoyned you for your work action he didn't just enjoin usapa, he enjoyned every us air pilot regardless of usapa membership. It is true she said that, yet more proof of how ridiculous the ruling was. Btw, like Eskimo joe says, doesn't matter, enjoining you would just be a "phyrric victory" for us since the arbs weren't ordered to use Nic. Just chaps me you got away with harming me with no punishment, not even a symbolic one.

Did you fare better on the AA proposal or the West proposal? All of my friends flying back east are near the very bottom of the list on the AA proposal.
What's the strategy now? Battle it out or withdraw and try to gum up the whole process via lawsuits?
