Now for the interesting point. Note USAPA is not directly challenging the arbitration. This is Federal Arbitration. The only legal avenue would be to file with the same board. It cannot be taken to Federal Court. Federal rules stand. USAPA is trying an end run by arguing for the Silver/ Ninth COAs. Trying to reverse a Federal Arbitration in-directly. That is why they chose counsel. He knows MB. But he won't beat RLA. East will fail their attempt. Novel approach, but they are skating on thin ice with a CBA interference injunction. The SLI will proceed, everything will be in place and USAPA will just have to live with it. As I said earlier, if Parker wants this settled, the big money will win. Expect a legal attack that will kill off the remnants of USAPA. Big money owns politics. Parker and the owners have the big money. Do the math.

The MOU timeline is dependent on many factors. SLI doesn't really start until JCBA completion, right? It's already a few months late, right? If we vote the TA down, it could drag out more, right? You said "on time", right? You're already wrong. Detail matter.

You're not much of a lawyer. Why don't you read Circuit City v. Adams. The FAA doesn't apply to transportation workers. This is arbitration under M-B. That statute rules. So while it is CORRECT that is Federal, the statute that CONTROLS is M-B....not the FAA.

You are the gift that keeps on giving. You see I just love irony, and you have a gift. The East also said Nicolau was not much of a lawyer. The East also said Judge Wake then Judge Silver were not much of a lawyer. Now the each PAB member is not much of a lawyer. The East also said the company and APA's lawyers were not much of a lawyer. The East DID say wait for the Ninth COA, they are good lawyers. The worst bench in the nation, reversed nearly 2/3s of the time! Did I mention I loved irony? You cite things as if you understand the complexities of law. You don't. You just pretend to understand. I am not a lawyer either. I was an attorney. I made much more money than a lawyer, screwing sheeple just like you with contract language. Mostly I don't care other than interest in the legal wrangling. But my best friend just retired from AA not long ago and I still have two working there. All three consider US one of the reasons they had stagnation for so long. You should have gone out of business instead of hanging on and bringing down the industry. I do admit I like to bait him with this stuff. I usually keep my comments for R57. He is not a numbnuts like others here. He does not pontificate on matters outside of his expertise (well, most of the time). You will just have to wait to see if my predictions are correct.
