Another question. If there was no problem with the Nic, why all the changes to ALPA merger policy? Why has a 3 member panel become the standard if one respected arbitrator was fine?

We never merged seniority lists, and that's a fact. We had a blueprint , but it has never been used. A new contract made it a nullity and a federal judge ruled that was okay. With all that, I cannot see an arbitration panel using the Nic. But, I don't know and admit I might be wrong. We'll see.

A distorted article by east shill Reid? He misrepresents the "tone" of what arbitrators write as he does everything else he ever writes. The arbitrators are only stating that Alpa changed the policy that they must follow, not that Nicolau got it "wrong". My point is that Nicolau, regardless how east pilots view him, is VERY well respected within the arbitrator community and it is that community that will be putting our list together. Again, if we get a seat at the table I will sleep very, very well regarding my nic position within the usair

How about Bloch? Is he respected? He came to completely different conclusion about the state of the companies, the state that Nic used as an excuse for his disaster.

R57, you think there is one arbitrator in this country that is not aware of what the east has done to avoid the Nicolau? I'm not saying they agree or disagree with what the east has done (I've been wrong plenty) but from a "reasonable" standpoint, what do you think the likelihood is that these arbitrators agree with the east tactics? I would think the east will have a very hard time convincing them to ignore a 2005 merger.
