But...........those three parties have ulterior motives and their opinions really don't matter. Here is what the 9th said about it:
"[4] A question is fit for decision when it can be decided
without considering “contingent future events that may or

The MOU is contingent on a merger. That merger could still come off the tracks. It would be stupid for USAPA not to argue this point.

Whatever she decides will be contingent on merger closing. Well the never ending litigation is proof of how bad the 9th majority screwed up.
