The 9th also stated that a JCBA not encompassing the nic would not necessarily harm the plaintiffs as feared..Silver gave a lot of oppinions, in the end she could not enforce the nic. Why is that. If its such an open/shut case??

Think the 9th also said, can't rule on a bargaining position. Come to us with finalized work, and show us how you are harmed by the final document. THEN we can rule. As they don't work in assumptions or what the West THINKS will happen. As one judge stated, Just because they NIC isn't used, doesn't automatically make a DFR......as whatever is the end result MAY not harm the west, without knowing the end game, can't rule.....Not Ripe......

Have a feeling your gonna hear those words again.....

Yes, I have no doubt once this dispute is resolved, the snarling will be angled in our direction by the pack of foaming mongrels with both red and tan collars seeking their next piece of meat.

thAt was the 9th explaining why they believed the case did not meet the "ripe" doctrine. So what did the "painfully ripe" comment by the 9th mean?



Silver gave a lot of oppinions, in the end she could not enforce the nic. Why is that. If its such an open/shut case??
its explained in all the court filings. The 9th made a joint contract a requirement for the dfr1. You guys just fail to realize that the facts have changed. The 9th ruled based on usapa/company negotiating a new list to be applied to the west, then and only then could the west know if it had been harmed(a ridiculous ruling btw). As of today those negotiations between usapa and the company on a seniority list the 9th used as an excuse for the "ripeness" test no longer exist. Because of the mou, dfr claim is ripe the minute usapa proposes something that harms the west.
