The 9th also stated that a JCBA not encompassing the nic would not necessarily harm the plaintiffs as feared..Silver gave a lot of oppinions, in the end she could not enforce the nic. Why is that. If its such an open/shut case??

Wow, that's quite an emotional threat considering no one yet to my knowledge has conveyed any such thing. Jesus, it looks like there are so many rabid dogs over there, you're biting everyone who walks by.

Think the 9th also said, can't rule on a bargaining position. Come to us with finalized work, and show us how you are harmed by the final document. THEN we can rule. As they don't work in assumptions or what the West THINKS will happen. As one judge stated, Just because they NIC isn't used, doesn't automatically make a DFR......as whatever is the end result MAY not harm the west, without knowing the end game, can't rule.....Not Ripe......
