Jeez...you must think I'm Sherlock Holmes with that clue. This is such a fun game, rather than just tell me why I'm in "error", let's drag this out by making me dig for it. That way when I discover it on my own, I'll receive some kind of error-correcting epiphany.
Who was working when?....-Not wanting to go to the actual trouble of finding a copy of the Nic, let me run that through the old permutation/iteration/speculation computer:
All AWA pilots were working at the time of the merger. Ding)))
Not all USAir pilots were working at the time of the merger. Ding)))
The term "time of the merger" seems vague. Ding)))
Some portion of furloughed USAir pilots were expected to be recalled between the time of merger announcement and the announcement of the Nic, creating a certain demographic instability in status and expectations for any contemplated seniority lists during arbitration. Ding)))
In an uncertain, changing demographic environment, an arbitrary point in time must be chosen so as to eliminate the aforementioned instabilities and uncertainties, -a logical point in time chosen so as to fix the status and expectations of those involved. Such logical point in time is traditionally "date of announcement of the merger". Ding))) Ding)))
The status and expectations of all pilots involved were frozen as of the aforementioned "date of announcement of the merger" Ding))))
The seniority list was constructed based on the status and expectations of those involved frozen at the aforementioned date. Ding)))
The USAir pilots were not happy with their status and expectations being frozen on said date. Ding)))
The arbitrators could hardly be expected to change such status and expectations on a day-to-day basis as the arbitration proceeded. ding)))
The arbitrator, not being expected to change such status and category for said USAir pilots in such ongoing process...didn't make such changes. ding)))
Result: The Nicolau Award. Logically based on actual number of pilots working at date of merger announcement.

Another clue Sherlock-I'm not only talking only [formerly] furloughed pilots. The status and expectations for all pilots were not locked in at the time of the merger and that is one of my big issues. While talking about [formerly] furloughed pilots, look at the date of the list he used and his logic for using THAT list. Then he didn't apply that logic to one group of pilots.

I guess we will just have to wait and see what this new panel comes up with. I understand however that the west will be there pushing our agenda of the NIC, has your BPR told you yet?
Don't be mad man, I know that Wiggy makes you look foolish but really you make it so easy to do. I dont recall that you had issues with Carl when he was on here pushing your land grab agenda, hmmm wonder why as he too is a DAL pilot.

And I have shown you that you were wrong as well so that just about evens that score however I still have the edge with regard to integrity. I was fully willing to accept what ever that arbitrator laid down and had no plans of not honoring that agreement.

Ohh you sound soo angry. Lets concentrate on the final binding arbitration results first shall we? We will get to the MOU later on when we face the new SLI. Now lets get back to the LAND GRAB comment I made. On the day of the merger WHAT SEAT WERE YOU IN RELAY????? Many here what to know the answer and your motivation?
