New developments that actually aren't so new as there has been much work behind the scenes with company and apa. I highlight the passages I think are important
So the case is not closed and won't be until the appeals are exhausted. We will keep usapa in litigation until they are decertified.
Which is what the APA has proposed and the company supports as a party to the process.
Apa and company are in agreement on how to move forward here.
You guys know Freund, nuff said on that.
Once the National Mediation Board certifies the APA as the exclusive bargaining agent for both pre-merger US Airways and American Airlines pilots, the APA will owe a Duty of Fair Representation to all pilots – equally. It will also be the APA’s and the Company’s responsibility to ensure there is a “fair and equitable” seniority integration process as mandated by the McCaskill-Bond legislation. Creating three separate merger committees to “represent the disparate seniority interests” is, in our opinion, the safest method for the APA to comply with its DFR to all New American pilots, as well as comply with the McCaskill-Bond Act.
It can hardly be disputed that during the past six years, USAPA has repeatedly demonstrated hostility towards the West pilots in terms of seniority. We anticipate that APA has no interest in taking the path chosen by USAPA.
In expectation of APA honoring its duty to all New American pilots, we believe the West pilots need an SLI attorney and are pleased to announce that we have been able to retain Jeff Freund to assist us in that capacity. Please join us in welcoming back Jeff.
We know the West pilots will share our exuberance over this development; the attorney who brought us the Nicolau will now be working side by side with the tremendous litigators who stopped USAPA dead in their tracks for six years.

I have no new legal theory, and my F/Os are not the angry F/Os, you fellas back east have that market cornered all to your little old selves. I'm just waiting for the upcoming implosion in CLT and PHL when the rank and file realize that they have been lied to yet again by the ones who they have chosen to lead. Very few of you guys pay attention and there is a lot of confirmation bias going on. He'll, Streble has been telling people USAPA will be around as the CBA for 18 more months. How ludicrous does it have to get for you guys?
There will be 3 parties at the table and we will get to present the Nicolau. What the arbitrators do with that is unknown, but without AOL and west pilots unity we would never have had a chance to correct the damage that USAPA has brought to both sides. Your retro check does not make up for the years you spent on LOA93.

There is no third list at USAir.
Explain why relative position was good for junior sand pilots but not good for former third listers? Don't act lika a hypocrite.

I will try to explain it to you in a way you can understand. When AWA and USAir merged there were two different companies and operating certificates coming together to form ONE airline. So the two lists had to be merged into ONE. After that occurred the NEW USAirways hired pilots, including you.
Obviously the East had big problems with the NIC and the rest is history. But there is zero ambiguity as to the circumstances of third listers. By DOH or ratio slotting you were hired after the POR. I will say it again so it will sink in. You were hired AFTER the POR or Snap Shot or whatever you want to call it. Placing you ahead of any pilot at the new USAirways would be re-ordering the pilots. It's so simple any 10 year old could understand. We are not merging three airlines. AWA and USAir merged years ago before you were hired.
Lets assume that American goes down the same path and US Airways and American operate separately for the next 8 years. Is there any scenario under the sun where you would find yourself junior to someone hired at American Airlines 2,5, or 8 years from TODAY? Of course not. Now put down the crack pipe before someone catches you.
