Umm have you forgot the case law the east established? The apa can renegotiate anything it wants at any time.

Subject to their DFR right? If they use the Nic award, what % chance do you give a DFR suit from the east? Considering that the MOU abandoned it and we have already had a federal judge rule that was okay?

CB and WD won't show us a single document that requires anyone to use the Nic, yet CB seems to hope that APA will renegotiate the ratified MOU in order to establish a requirement to use the Nic.

Let's go ahead and assume they could get it ratified over the objections of many former AA and USAir pilots, could they prove to have a legitimate union purpose for doing so?

CB is desperately hopeful.

sounds like you have an airtight dfr. now you just have to wait until the new list is in effect to sue. Oh and btw, who you going to sue if e arbitrators pick the Nic?

Not at all, my hope is pinned on the west having a voice. I know that scares the crap out you guys. I think r57 already figured out what the apa passed and expects in the protocol agreement regarding west reps, you will catch on soon.

I know one west guy who is 7% from the bottom on the west list. 15% from the bottom using DOH. 25% from the bottom using the nic list. I asked twice about that to make sure.

He is fighting hard for the nic list also. How that is not a huge windfall, I don't know.

Because date of merger in 2005 that guy was 25% on the west list. How is that hard to comprehend? I was a mid 1998 hire 757 captain in 2005 on date we merged, lost my seat and moved backwards in 2008. 3 full years after we were a single company. So you see the Nic was based on positions held at pid not what we can hold 7 years later after the east forced separate ops and worked for less money and benefits. What you see on the Nic is what people held date of merger back in 2005, if anything it is glaring proof of the outright theft of west jobs by east pilots.

No it wasn't. It was based on what you held in early 2007, after the east dropped twice the hulls the west did, yet recalled about 300 pilots. Unless you were a formerly furloughed east pilot, then you were the ONLY group held to your May 2005 status. Perhaps you've heard about the Nicolau decision and award? Maybe you should read it some day


What's with all the history? Back in 2007 you didn't want to consider history, just what ypu had then. Ever heard "Be careful what you wish for!"?
