Here is my thinking and thats all it is MY THINKING. SWA and JB want into national but cant get there right now with LCC hogging up all the slots. Now the DOJ could gamble and if they lose SWA and JB get nothing which would suit Parker just fine. I would think that the other two carriers would be applying pressure on the DOJ to settle so that they could get in thus removing any antitrust issues.

Nothing can be resolved until a contract is voted on. Without something else to replace the Nicolau that is the list. And while USAPA can offer any list they want, their list will still be scrutinized by a judge to pass the DFR standard.
Wilson polling during ALPA's tenure on the property said that a majority of the East pilots would have voted for the original Kirby proposal with the Nicolau. The east MEC saw those numbers and pulled out of the joint negotiations, knowing the USAPA drive was coming. USAPA then repudiated every section of the joint contract that had been TA'd, thus putting joint negotiations back at square one. We are now parked by the NMB so without this merger it will be a very long time until we have to worry about the Nicolau Award because we will have to have USAPA negotiate every other section of the contract first. Since only about three or four sections are TA'd now I will be retired before we ever get a joint contract on our own. USAPA are kings at snatching defeat from the jaws of victory.

The company has no incentive to really negotiate. They have this seniority mess to use as an excuse and delay, saving hundreds of millions of dollars. We have to take that away from them, but I see no change of heart on either side. Maybe the DJ appeal will settle that. We need to be getting paid why you guys sue.

Since AOL's attorney says the west has no case absent a merger, I'd say we wait for the company's DJ appeal, see what they say and go from there. At least 1-2 more years of status quo I'd guess.
What about if the merger does go through? Silver seems to be leaning toward granting the west separate status(she has said she can't force the Nic, but she has changed her mind before. I won't put any money on her one way or another). So, if she does that, how does the west "elect" it's reps. And the bigger question, who do they sue if things don't go well?
