Why ask a dumb question like that. It would be better to say that "we in the east have successfully stalled the implementation of the award results that we had agreed to honor at the start."

Now that would have been a better way to put that dont you think? BUT that stalling also came at a great price and much crying in the east for parity now didn't it? That same stalling held you and many other captains in the narrow body a/c hostage at an embarrassing $124/hr where many other carriers have first officer making more than that. Oh I wont even get on wide body pay as that is an even bigger joke. So you see Relay when you set out to try and make it seem as though you have really won something, we all know that you have lost. The winner was Douglas Parker because he used your obvious stupidity to keep you held hostage at that staggering low pay. Tell me something, when you hear "spiritwings" on the freq how does it feel to know that a carrier that small has pilots that make more than you to fly the same equipment? Stupidity runs very deep in the east and all you did was dig a financial grave for yourselves. Cried and begged Parker to give you at a minimum parity with us, how did that work out for ya??

See the exhibit where USAPA said that no west pilot should vote for the MOU thinking that it completed the Nicolau award and no east pilot should vote against it because they fear it would implement the Nicolau award. The language is clear. You guys are the ones trying to pull a fast one.

This is your exact scheme:

-vote yes knowing the MOU doesn't include the Nic
-after a vote, the DFR will be ripe because you have a "contract."
-file a DFR claiming that portion of the MOU is unlawful
-get an

Sure is, not being used because there is no single agreement. Now everyone (Silver)but usapa agrees we have a single agreement at por. The MOU only modified east COC and fleet minimums in the TA, seniority requirements were left there. So the TA still governs east west seniority.

I did answer your question albeit not the way you wanted to hear it though huh? I just told the WHOLE truth instead of the east way of telling only that which makes you look good. I know you dont want to acknowledge the part of your lack of integrity but I would be remiss If I were to allow you to do that.

So what did/does this mean to you?

I have already told you, the TA governs east/west seniority. Read it again, "neither the Mou or jcba shall provide basis" we agree the TA is what provides that. " other than through process st forth in paragraph 10" Read 10 again, does it talk about a 3 way? Read 10a and tell me where it says separate east/west lists are presented? 10a etc speak only to us/aa MB process.

Default Aol update 7/25

Today, our attorneys filed an amended complaint in our lawsuit against USAPA which is before Judge Silver. You can read the amended complaint here.

The amended complaint is identical to the original complaint except for the addition of a fourth claim. Although the Amended Complaint retains Count II, which was the claim against the Company, it does so only to avoid waiving our right to appeal Judge Silver’s ruling dismissing the Company.

This additional claim asks for Judge Silver to declare that, pursuant to McCaskill-Bond, the West Pilots are entitled to have party status, and the right (but not the obligation) to participate fully (with counsel of their own choice) in the MOU Seniority Integration process. The basis for this request is the demonstrated inability of USAPA, or any merger committee that it forms, to fairly represent the West pilots in a seniority integration. Now we are beginning another merger; one which will create the world’s largest airline with the world’s largest pilot workforce. Two seniority lists are going to have to be integrated via the McCaskill-Bond process. Implicit within McCaskill-Bond is the fundamental assumption that each bargaining agent can freely and adequately represent its respective members’ interests. For USAPA, that is simply not possible. Since prior seniority integrations have provided for third party representation, the West is requesting separate and equal standing in this seniority integration. We are confident that the Nicolau will be the list which is used for the McCaskill-Bond process. Separate West presence will help insure that the Airways-American seniority integration is not corrupted by lingering prejudices within USAPA.

You are making assumptions, and I'm sure that is because that is what your handlers are telling you.
