I did read it so did my lawyer. Seniority "neutral" for east and west. I know you are thick headed but even your attorney told as much to Silver.
Well ookie here, usapa said the mou didn't impact the Nic. and got the west to vote for it, after the vote usapa changed it's tune.
And one more
So the west/amr/company/Silver all say it was seniority "neutral' in regards to east/west issue. Of course the scum union doesn't agree with that even after placing it in writing.
USAPA may have tried to make clear that don't
vote in favor of it or don't vote against it because we are not
rejecting the Nicolau Award or we're not accepting it, which is
precisely what I asked you to do.
And then you, based upon that, there was a vote and
98 percent of the West Pilots went along with it. But then
subsequently, what do we have here after that? What do we have
USAPA doing? Isn't that what I need to look at?

THE COURT: Okay. Then I missed the timing here to
some extent. I thought that after the Memorandum of
Understanding was reached and there was a vote in favor of it.
It seems quite clear to me that Memorandum of Understanding was
meant to be neutral on seniority, that there were some
negotiations after that.

Just keep telling yourself this was about honoring the TA. The one thing everyone in the industry can do is see right through the east's motives. No doubt those actions kept me at lower pay but rest assured it kept yours the same as well which is below mine.

Lets review from the MOU:
USAPA agrees to waive all change of control provisions, including, but not limited to, Section 1.D in the East collective bargaining agreement, LPPs, daily minimum utilization, and minimum fleet requirements in the East and West collective bargaining agreements and in the Transition Agreement conditioned upon the occurrence of the Effective Date.
15. US Airways agrees that it will comply with the East and West CBAs and the Transition Agreement until the Effective Date.

You might very well get the Nic. I actually think you will; however, it might take a decade. There will be a ruling and several appeals (status quo) and perhaps in a decade from now the Nic will be implimented. Between now and then you'll spend another decade in Phoenix (if it stays open) at your same relative position. The east DOH crazies will mostly be retired in a decade.
3rd lister crystal ball says when you get the Nic implemented 75% of the east list will be retired. You do the math on what you gain under that scenario.
Big picture in this merger with AA:
AWA pilots score (USAPA gone,$,Nic, etc)
3rd listers really score (inherit the combined airline)
AA status quo

The TA is still in effect, and will be after the POR. The TA is completed once we get a single contract at POR. BTW go read the MOU again and look at the specific language that amends our TA, the seniority portion of the TA was not modified, the MOU makes clear tha east/west seniority issue is not addressed by MOU. So to review what does the MOU the west voted overwhelmingly for do? Makes it "ripe". What does the MOU not do? Doesn't address east/west seniority in the least. Go read 10 H again, it says the "mOU" doesn't change the lists currently in existence, we agree, it's the TA that does.
Lets review from the MOU:
So where does it say we waive the seniority provisions of the TA?
Well looked here, the TA except as modified by the paragraph above is in full force and part of east and west contracts as modified by TA

I never expected to be any where but at the bottom of the combined list.

Like the east pilots like to say, "You can have the airline when I retire." In my case that'll be in 25 years. Being sarcastic
