The point is that you made an agreement then went back on that agreement and have convinced yourselves that it was the noble thing to do. When you say " I will do this and honor the outcome" then you don't that makes you a LAIR. When you put together an organization to bring harm to the very group that keep you employed after your company failed, that makes you a low life thief. Not clear on any of this? Go back and read it again until it sinks in.

What are the two lists that are possible after she rules? That is the crux of the matter. It's either the Nic. As required by the TA or any other list usapa desires. So when she looks if it was permissible to not include the Nic as required she will compare them to arrive at her decision.

MR. SZYMANSKI: Changes in the date-of-hire proposal, not changes in the Nicolau proposal.
THE COURT: Well, you never said that. If you had said that in open Court, then we would have had a hearing at that time because the issue was what I made quite clear is that you had to go forward. USAPA had to go forward and with an open mind and that the Nicolau Award was not irrelevant. It was to be considered.
