Wow, that's a strongly worded sentiment. A question: Where does ALPA fit in to this statement? Because last I checked, ALPA has had a long history of one blow to major airline pilots after another, while at the same time representing countless regional airline pilot groups that have exploded at the expense of major airline pilot furloughs. What has ALPA done to stop that? How can you blame APA, representing ONE pilot group, for "leading the rest of the profession down the drain" when ALPA has done exactly that while representing HOW MANY major airline pilot groups???

Secondly, APA was THE ONLY major airline pilot group who stood up to management's outrageous and hideous attempt in absolutely DECIMATING our careers in Ch 11 BK, spit in their faces, and in the meantime engineered a merger IN BK while kicking current management to the curb. WHO HAS EVER BEEN ABLE TO PULL THAT OFF?? Granted, we had previous Ch 11 cases to study and learn for, but I don't think it would be a stretch to **THANK** the APA for setting the standard for all future airline BKs and the raping associated with that.

APA had a clear cut strategy from the beginning of the Ch 11 filing and it worked. We now have better management and the start of a new beginning while we were able to preserve much of our old contract AND get increased pay rates out of it.

I'd say APA RAISED the bar for the profession this time around.
Great response from someone who obviously knows some pilot history. ALPA, APA and all the associations are seriously flawed and have been relegated to speed bump status as airline managers have rushed to diminish our profession since deregulation in 1978. The AA "B" scale was indeed a copy cat move by Bob Crandall, however it stuck and established the "industry standard" from that point on. APA has been subject to the "Lucy Syndrome" for its entire history, trusting management to let them have a better chance to kick the ball the next time, only to have management pull the ball away at the last moment. For their cooperation, APA officers and BOD members have been rewarded with management and check airman positions at a rate that far exceed that of the lowly line swine. Hopefully your optimistic predictions for the combined pilot force will come to be, but you must admit history has shown that pilots have been their own worst enemy and unfortunately this will probably be the case at the new AA. It would be historic if all the pilots involved could come together for their own sake and for the good of the profession but it is more likely that the food fight that has been going on at LCC for years will just get another group of players. Hopefully the young Turk's will realize that a 1930's structure has no place in the 21st century and will come together over company lines and either restructure ALPA or create a whole new entity. Either way the only way to advance is as one group, 70,000 strong. The airlines have their corporate "union" and have perfected the art of pattern bargaining resulting in the average pilot being compensated at rates 40 to 60 percent below our predecessors. With only three major carriers, four if you include SWA, one would only hope that consolidation of the profession would be a much easier task.

Night Hawk- It is always interesting and a pleasure to read your post. Yes, " the only way to advance is as one group, 70,000 strong "- Here's hoping that we have emerged from these difficult times with this mindset.

The mega-merger is back. But will the Obama administration approve?

Not since the bygone days before the financial crisis has there been such a flurry of headlines about big deals.

On Wednesday, Office Depot and OfficeMax announced plans to merge in an all-stock deal worth roughly $1.2 billion that would combine the second- and third-biggest office supply retailers. Last week, there was Berkshire Hathaway’s $23 billion bid for ketchup king H.J. Heinz in addition to the mega-merger between U.S. Airways and American Airlines.

All this news has sent stocks up on Wall Street, where some are hailing the return of the blockbuster merger. But in Washington, a number of these deals first have to win the approval of antitrust officials — a crowd that looks increasingly tough to please going into President Obama’s second term.

In the past year and a half, the Justice Department has shown a new willingness to outright block big deals, either by going to trial or by persuading companies to scuttle their plans.

The government scored a big win at the end of 2011, stopping the deal between AT&T and T-Mobile, which antitrust officials argued would have hurt consumers. The administration also successfully stopped H&R Block from acquiring a low-cost rival, going to court for the first time since 2004 to challenge a merger. And just last month, the division moved to block a proposed deal by beer giant Anheuser Busch InBev to purchase Grupo Modelo, saying it would harm competition.

There’s also a new antitrust cop on the beat. At the beginning of this year, the Justice Department’s antitrust division got its first permanent antitrust chief since August 2011. Fellow lawyers describe William J. Baer as “an antitrust attorney’s antitrust attorney,” someone who has spent his entire career thinking about this area of the law and who won’t be afraid to take cases to court where necessary.

Before joining the Justice Department, Baer worked at Arnold & Porter and served as director of the Federal Trade Commission’s competition bureau, which shares antitrust enforcement responsibilities with the Justice Department.

Expectations are high because Obama has promised since 2008 to “reinvigorate” antitrust enforcement.

In the first half of Obama’s first term, the Justice Department was measured, approving a number of big deals after adding some restrictions on how the companies could behave. The division ultimately gave the green light to controversial mergers such as the Ticketmaster deal with Live Nation, Comcast’s acquisition of NBC Universal from General Electric, and Google’s purchase of travel-software company ITA.

Critics who wanted more aggressive enforcement said the division was too timid about bringing cases to court. Some have also noted that despite the growing dominance of companies such as Google, antitrust enforcers have yet to build a monopoly case in the mold of the government’s long battle with Microsoft in the 1990s.

Daniel Crane, an antitrust professor at the University of Michigan Law School, said the Obama administration may not have leapt out of the gate in the first term because the economy was in a free fall. Crane has done research showing that during economic crises, antitrust enforcement tends to take a back seat.

“It’s very hard to mount a very vigorous antitrust campaign when you’re looking at a lot of businesses that are failing,” Crane said.

But now that things have stabilized, he added, “it would not surprise me to see more vigorous enforcement of antitrust in the second term.”
