I think it has more to do with our Japan routes. They’re lottery based and Alaska is attempting to bypass the lottery since it will technically be a different airline certificate operating the flights. I’m curious if they end up keeping the HA operating certificate post merger because of this…

DOJ has much stronger legal teeth to oppose. As far as I know DOT can't block the meger just because, about all they can do is insist on some fine-tuning from a regulatory or diplomatic perspective. If they push too hard, or stall, they'll lose the lawsuit.
Anti-trust law favors big government (as NK found out). That ship has sailed in our case.
Deregulation Act favors airlines.
Also Mayor Pete is a very ambitious political animal. Consider what's in his best interests long-term.

The DOJ anti-business activists don't care about optics. The administration might, with an election around the corner, but DOJ and DOT get their marching orders from the same place.

The bigger question for me is why the deafening silence from both airline's management on this?
