Not saying this will happen, but I've read some news in the past where the DOJ sued after a transaction was completed and after giving their blessing.
There wasn't much of a "blessing" here, more like loud silence.
Wanted to clarify, probably not what is happening but the news isn't very exciting... and as you said there aren't champagne corks hiting the ceiling yet

The DOT is bound by the airline deregulation act... they are actually precluded from meddling in routes, marketing, and other business factors. They should be focused fundamentally on safety.

At this point it looks very much like Trump will win, so the current bureaucrats might be wracking their brains to figure out how to leverage their authority to throw a wrench in the works, before they get their walking papers.

Such a lawsuit would have to be based on something, like non-compliance with the original proposal.

We're not going down the partisan road, but my college room mate congressman (D) thinks that it will be Trump, and that's what a lot of folks in DC are resigned to apparently. Not getting into the media fluff and all of that but it's looking like 2016 again so I wouldn't necessarily believe what you see in the news.
The VP is obviously a more electable candidate than the obviously impaired P, so it is more of a contest than it was a couple months ago.
