I’m actually pretty surprised that there were no concessions extracted by the DOJ.

Alaska and Hawaiian have applied to the DOT for a transfer to operate under one certificate, and for an exemption to allow that happen before they are under one certificate. The airlines have been cooperating with the DOT on these for some time already. The DOT can deny these applications however the DOT is supposed to defer to the DOJ and not stop the merger if the DOJ does not object to it. In the case of Spirit and Jet Blue the head of DOJ, Buttigieg, said DOT would deny the application even if the courts ruled against the DOJ decision to block (Senator Elizabeth Warren said she would get involved as well, though not sure legally how that would go). Short answer is that it would be extremely unlikely for the DOT to take a different stance than the DOJ, however they do have some approval authority on the operating certificate side of things. Short answer is yes, they can block this, but very unlikely in light of DOJ decision.

IIRC the Deregulation Act specifically removed a lot of .gov's ability to nit pick air carrier structure and operations (except the safety part).

DOJ considered the anti-trust aspect, which is addressed by unrelated federal law. With that hurdle cleared, the law is on the side of the airlines now.

I know nothing but as far as I understand it, the DOJ could block the merger. Now that the DOJ hasn't blocked it, this merger is effectively happening. DOT stuff is basically filing and applications to operate according to the DOT which both airlines do already. Applications that have been filed requesting changes, can be denied but really at this point, this is the infancy stage of two merged airlines.

I think by close of business Thursday we are considered official owned and operated by Alaskan Airlines. If I rememeber it was 3 days after DOJ approval (or lack of being contested).

Hopefully the waste cutting is swift. Way too many people at our HQ making way too much money to do a poor job.

Curious, will Alaska still want to continue with PF/PM on the 330/321? Or did HA just waste millions (as usual) with something that isn't going to happen?

Probably won’t matter, those airframes will likely be gone in 5 years.
