Actually his firm filed it electronically and signed it for both attorneys. Most pleadings are filed electronically anymore. No I was referring to the other attorney of record who appeared with her in the ABC interview. Interesting to read his bio, he is mostly a personal injury lawyer, with very little background in employment law or sexual harassment cases. Same for Makus. Mostly personal injury and criminal defense. Hard to say at this point who is the lead sled dog, although I would probably say Makus is since he was with her in the ABC interview.

Hmm, okay. The posts are difficult to follow. Sometimes it's challenging to figure out if someone is a troll, or if everybody already knows their story.

Exactly. Until you have all the evidence, you can't say for sure what happened. You only have one side of the story, there are two more still to come.

IF, her legal team has their evidence and discovery gets all the results of the company investigation; it’ll be AK’s decision to settle with NDAs keeping it quiet. The captain won’t have boo to say in defense. Then, the company may decide to terminate him or they may not. I’d bet if the evidence is persuasive; he’ll be gone.

It's great having all these Legal experts as well as Statistic PHD's here. What's the opinion the accused Capt has a law suit for destroying his career and his character?

Do not ignore the issue of the Union in all this. Even if they are convinced of the individuals guilt, they have a legal obligation to enforce any protections in the contract, and the contract almost certainly was NOT written with THIS event in mind.

Well unfortunately for AK this has gone way past the point where they can keep it quiet. Whatever happens they are going to have to make some kind of public statement which will probably rely heavily on their investigation.

One big hole in her legal team is, according to everything publicly available on them, they have no background in employment law or sexual harassment cases. Both are personal injury lawyers, and one has a background in malpractice and the other in criminal defense. AK hired an attorney with a 25 year background in employment law, harassment cases, and workplace violence to investigate this.

Keep in mind the company already has the findings of a very good attorney in employment law cases, and they haven't fired him. In fact every indication was he was going back to work until this lawsuit was filed. So if this lady found anything indicating what this FO said was true, it is highly unlikely he would be going back to work.

We'll see where this ends up.

Well the old saying is the best defense is a good offense, so a countersuit is always possible. But I'd say any attorney he is going to hire is going to worry about a criminal investigation first, and keeping his job second. Any potential litigation by the Captain is probably another reason why Alaska hired the attorney they did and conducted an investigation. Alaska has to make sure whatever decision they make is bulletproof and can stand to defend the company in any litigation.
